Terms of Service

These Terms of Service ("Terms") govern your access to and use of Lumvix (the "Service"), operated by the Lumvix service operator ("we", "us", "our"). By creating an account, ticking the acceptance box at signup, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Lumvix lets you generate images and videos from text prompts and uploaded images using third-party artificial intelligence models running on third-party infrastructure. Generation consumes credits. The Service is provided for lawful, personal and commercial creative use.

2. Eligibility and accounts

  • You must be at least 18 years old to use the Service.
  • You must provide a valid email address and keep your account secure. You are responsible for all activity that occurs under your account, whether or not authorised by you.
  • One free-credit grant per person. Creating multiple accounts to farm free credits is prohibited.
  • We may refuse, suspend, or terminate accounts at our sole discretion, including for breach of these Terms.

3. Credits, subscriptions, and payment

  • Credits are a limited, non-transferable, revocable licence unit used to meter generation. Credits have no monetary value, are not property, cannot be exchanged for cash, and are non-refundable except where required by law.
  • Subscriptions are billed monthly through our payment processor (Stripe) and grant a monthly credit allowance and premium queue access. Subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the current billing period; no pro-rata refunds are given for partial periods.
  • Credits are deducted when a generation is requested. If a generation fails due to a Service error, the credits for that generation are automatically refunded to your balance. A generation that completes but does not meet your expectations is not a failure and is not refundable.
  • We may change credit prices, generation costs, plan contents, and free-tier limits at any time.
  • Free-tier accounts are subject to daily generation limits and lower queue priority.

4. Your content

"Input Content" means prompts, images, and other material you submit to the Service. "Output Content" means media generated by the Service in response to your Input Content.

  • You retain ownership of your Input Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify, and process Input and Output Content solely to operate, provide, secure, and improve the Service, including transmitting it to the third-party model providers and infrastructure providers that perform generation.
  • Subject to these Terms and to the terms of the applicable model providers, we assign to you all our right, title, and interest in Output Content generated from your requests. You are solely responsible for your use of Output Content, including verifying that it does not infringe third-party rights and that it is fit for your intended purpose.
  • AI-generated output may be inaccurate, may contain artefacts, may resemble other users' output or existing works, and may be subject to uncertain intellectual-property treatment in some jurisdictions. We make no warranty of originality, accuracy, or non-infringement of Output Content.

5. Uploaded images — your warranties

By uploading an image to the Service you represent and warrant that:

  • you own the image or hold all rights, licences, and permissions necessary to upload it and to have it processed and transformed by AI models;
  • if the image depicts an identifiable person, you have that person's explicit consent to upload and transform their likeness (or you are that person);
  • the image does not depict any person under 18;
  • the image does not infringe any copyright, trade mark, privacy, publicity, or other right of any person;
  • the image complies with the Acceptable Use Policy below and all content guidelines we publish.

We may scan, moderate, reject, or remove any uploaded image at any time without notice. Uploads that breach these warranties may result in immediate account termination and forfeiture of remaining credits.

6. Acceptable Use Policy

You must not use the Service to create, upload, request, or distribute content that:

  • is illegal in your jurisdiction or ours, or facilitates illegal activity;
  • constitutes or depicts child sexual abuse material, or any sexual content involving minors — whether real, generated, stylised, or fictional. We report such material to the relevant authorities;
  • is non-consensual intimate imagery of any real person, or sexualised content depicting an identifiable real person without their explicit consent;
  • impersonates a real person or entity in a misleading way, including deceptive "deepfakes" of real people, or content intended to defraud, defame, or harass;
  • promotes violence, terrorism, self-harm, or hatred against any person or group;
  • infringes any third party's intellectual property or other rights;
  • is intended to mislead the public, including fabricated depictions of newsworthy events, election disinformation, or forged official documents;
  • contains malware or attempts to probe, disrupt, overload, or reverse-engineer the Service or its models.

You must not circumvent rate limits, queue tiers, or content safeguards; scrape the Service; resell access without our written consent; or use automated means to create accounts or submit generations. Third-party model providers apply their own content policies; a generation rejected by a provider's safety systems is treated as a failed generation.

7. Moderation and enforcement

We may (but are not obliged to) monitor, review, filter, or remove Input or Output Content, suspend processing of any request, and suspend or terminate any account, at any time and at our sole discretion, with or without notice, including where we reasonably believe these Terms have been breached. We may preserve and disclose content and account information where required by law or to protect the Service, our users, or the public.

8. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to our designated contact (see Section 15) including: identification of the work, the allegedly infringing material and its location, your contact details, a good-faith statement, a statement of accuracy under penalty of perjury, and your physical or electronic signature. We respond to valid notices, including by removing content and terminating repeat infringers' accounts.

9. Third-party services

The Service depends on third-party providers, including AI model hosting (fal.ai), payments (Stripe), and cloud infrastructure (Cloudflare). We are not responsible for third-party services, their availability, or their output. Your use of the Service constitutes consent to our transmitting your Input Content to such providers for processing.

10. Availability and changes

The Service is provided without any uptime commitment. Queue times vary and are not guaranteed, including for premium tiers. We may modify, suspend, or discontinue any part of the Service at any time. We may delete generated media and uploaded images after a reasonable storage period. Keep your own copies of anything you want to preserve.

11. Disclaimers

THE SERVICE AND ALL OUTPUT CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY AND ONE HUNDRED US DOLLARS (US$100). NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING LIABILITY FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

13. Indemnification

You will defend, indemnify, and hold harmless us and our officers, directors, employees, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your Input Content or your use of Output Content; (b) your breach of these Terms, including the warranties in Section 5; (c) your violation of any law or third-party right; or (d) any content you distribute that was created using the Service.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time as described in these Terms. On termination, your right to use the Service ceases, unused credits are forfeited (except where a refund is required by law), and Sections 4, 11, 12, 13, and 16 survive.

16. General

These Terms are governed by the laws of the operator's place of establishment, excluding conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts of that place, unless mandatory consumer law provides otherwise. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. We may update these Terms; material changes will be notified via the Service or email, and continued use after the effective date constitutes acceptance.
